CAMDEN FIRES – TERMS & CONDITIONS OF SALE AND INSTALLATION
All quotations, contracts of sale, and installation agreements made by Camden Fires (“we”, “us”, “our”) shall be deemed to incorporate the following Terms and Conditions. No other agreement, representation, promise, or undertaking, whether verbal or otherwise, shall form part of or vary these Terms unless expressly agreed in writing by a Director of Camden Fires.
These Terms constitute a legally binding contract between Camden Fires, acting as supplier and installer, and the Client, acting as purchaser and recipient of goods and services.
1. CONTRACT OF SALE & PAYMENT
1.1 All quotations are issued in good faith and are subject to availability of goods and materials.
1.2 Full payment for all goods and materials must be received in cleared funds before goods are ordered and before an installation date can be booked.
1.3 The remaining installation balance must be paid in full on the final day of installation, unless otherwise agreed in writing.
1.4 Camden Fires reserves the right to require full payment in advance at its sole discretion.
1.5 Goods will not be ordered until full payment has been received.
1.6 Deposits and payments are non-refundable once goods have been ordered.
1.7 Where cancellation occurs after goods have been ordered or delivered, the Client shall be responsible for all restocking charges, delivery fees, courier costs, and any other charges incurred in returning goods to suppliers.
1.8 Failure to make payment on completion may result in legal action to recover outstanding sums, including statutory interest and reasonable legal and recovery costs.
2. DELIVERY & INSTALLATION DATES
2.1 All delivery and installation dates are estimates only and may be subject to change due to circumstances beyond our control.
2.2 Delays shall not constitute grounds for cancellation, compensation, or discount.
3. THIRD-PARTY WORKS & GAS INSTALLATIONS
3.1 Any works carried out by third parties, including gas installation, commissioning, or certification, remain solely the responsibility of that third party.
3.2 Camden Fires is not Gas Safe registered and does not commission or repair gas appliances. Gas installations are covered by the installing engineer’s warranty and the manufacturer’s warranty.
3.3 Camden Fires shall not be liable for any damage, defect, or issue arising from third-party works.
4. SITE PREPARATION & PROTECTION OF PROPERTY
4.1 The Client is responsible for ensuring reasonable access to the property and that the installation area is fully prepared prior to commencement of works.
4.2 The Client must remove or adequately protect furniture, furnishings, carpets, flooring, valuables, and personal items from the working area.
4.3 Camden Fires shall not be responsible for loss of or damage to items left in the working area. Any items left in situ remain entirely at the Client’s own risk.
4.4 Camden Fires does not cut, refit, or alter carpets, flooring, skirting boards, coving, or decorative finishes.
4.5 Camden Fires is not responsible for the removal of rubble or waste arising from third-party works or preparatory/finishing works not undertaken by Camden Fires.
5. CHIMNEYS, FLUES & BLOCKAGES
5.1 Camden Fires will inspect the chimney or flue as part of the installation process where applicable; however, certain blockages, defects, or obstructions may not be identifiable until works have commenced or access has been gained.
5.2 Where a blockage, collapse, excessive debris, or defect is discovered, Camden Fires reserves the right to stop works immediately where it is unsafe or impractical to proceed.
5.3 Removal of blockages, additional sweeping, lining, or remedial chimney works are not included in the original quotation and will be quoted separately.
5.4 The Client is free to obtain alternative quotations for blockage removal or remedial works.
5.5 Installation will recommence once the chimney or flue has been satisfactorily cleared and confirmed as suitable, subject to availability and revised timescales.
5.6 Camden Fires shall not be liable for delays resulting from blocked or defective chimneys discovered during installation.
6. ROOF ACCESS, TILES, GUTTERS & TWIN WALL FLUES
6.1 Where roof access is required, the Client acknowledges this is unavoidable and necessary to complete works safely.
6.2 Camden Fires will take reasonable care but shall not be liable for damage to roof tiles, slates, ridges, or roofing materials that fail due to age, wear and tear, fragility, or pre-existing defects.
6.3 Camden Fires shall not be responsible for damage to guttering, downpipes, fascia, or soffits where ladder or roof access is required. Where such components cannot withstand access, repair or replacement shall be the Client’s responsibility.
6.4 Where a twin wall flue system penetrates or passes through the roof structure, Camden Fires shall not be responsible for water ingress or leaks caused by roofing membrane failure, defective flashing, or existing roof defects. Any such issues are deemed roofing defects and must be rectified by a qualified roofer at the Client’s expense.
7. DOWNDRAUGHT & PERFORMANCE
7.1 Chimney performance cannot be fully assessed until installation is complete and the appliance is operational.
7.2 Camden Fires shall not be responsible for downdraught, wind-related effects, or ventilation issues.
7.3 Where required, remedial measures such as anti-downdraught cowls will be chargeable, including fitting costs.
8. UNFORESEEN WORKS
8.1 In the event of unforeseen structural, chimney, or installation issues, Camden Fires reserves the right to quote for additional works required.
8.2 The Client may appoint third parties for such works; however, Camden Fires accepts no responsibility for third-party workmanship.
8.3 The Client remains responsible for payment of the original contract value regardless of third-party involvement.
9. WARRANTIES & EXCLUSIONS
9.1 All appliances and materials supplied are subject to the manufacturer’s warranty.
9.2 The following are consumable / perishable components and are not covered under warranty:
- Stove glass
- Fire bricks
- Baffle plates
- Rope seals
- Door seals
- Grate bars
- Stove paint
9.3 Natural materials such as slate, marble, granite, and timber may contain natural variations and markings which are not defects.
10. SOLID FUEL & MULTI-FUEL APPLIANCES
10.1 Solid fuel appliances must be installed by a HETAS-registered engineer to maintain warranty validity.
10.2 Appliances must be serviced annually and chimneys swept at least once every 12 months.
11. POST-INSTALLATION & MAINTENANCE
11.1 It is the Client’s responsibility to ensure ongoing maintenance and servicing of the appliance.
11.2 Camden Fires shall not be liable for damage arising from misuse, lack of maintenance, or operation contrary to manufacturer instructions.
12. LIMITATION OF LIABILITY
12.1 Camden Fires shall not be liable for indirect, incidental, or consequential losses, including decorative damage or remedial works carried out by third parties.
12.2 Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability that cannot be excluded by law.
13. GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales.
